rear-ended (more bad news)

Everyone is ok (so far) but dd and I were rear-ended this afternoon. I had stopped because the car in front of me was turning left but the woman behind me didn't. She knocked us into the car in front of us so hard it crumpled the entire front end of dd's car. Other than checking to see if anyone was seriously injured we didn't talk to each other much. Got out of the flow of traffic and set in our cars (cause it was freezing outside!) til the police got there. Then I just let him handle it. When I called my insurance company he took all the information I had and gave me a claim # and said someone would call be by noon tomorrow! I said "On Sunday?!" and he said yep. I expect to be very sore Sun & Mon. I don't remember my glasses being knocked off my face but the temple pieces are sprung.

Oh, Judy! All this is THE PITS! without any fruit!

We are getting our car back tomorrow from the accident dh was involved in on Christmas Eve. I know these things aren't equitable even considering IF they would have paid for the vehicle entirely.

Almost 10 years ago I was rear-ended in my mini-van with 116,000 miles on it. I, too, was hit hard enough to knock the glasses off my face. The van was totaled, too. That van was 6 months from being paid off, so I can relate to a lot of what you say.

I'm really, really, glad you and dd are o.k. Proceed cautiously. Don't sign anything without going over it carefully.

It happened in Gwinnett, Dawn, near Gwinnett mall and I don't appear to need a personl injury atty.but thanks anyway. We were a little stiff and sore but that passed in a couple of days. My problem now is transportation. We go tomorrow to pick up a check from our insurance company but it will not even come close to replacing the car (will be doing good to get $2500) it was 9 years old but still ran great. I plan to ask him if signing the subrogation papers so they can sue her for reimbursements will prevent me from suing her myself for our out of pocket expenses not paid by my insurance. Like the rest of the money necessary to get a reliable vehicle.
Dd found a car just exactly like hers on the internet last night. It was weird, same year, make, model, color and mileage for $2999 at Saturn of Roswell. I called a friend in the shop at Saturn of Decatur (where dd's car came from) and she had a sales person check on it for me. No deal, it was sold on Saturday. The sales lady at Saturn is still looking for something along that line for us.

Sorry to hear that. That really stinks. I hope that things work out for your daughter. I don't know anything about that type of law...

I do know one very good personal injury attorney though if you need a name. He is in Cobb Co, but he may be able to recommend someone in your area. In which county did the accident occur?

If a person has collision coverage, the insurance company will pay their insured, and then go after the uninsured at-fault party for their costs, and the insured's deductible. The insurance company can set up a monthly payment program with the uninsured at-fault party, or hire an attorney if necessary. Full recovery is rare, and if the uninsured at-fault party has little in the way of assets/income, the insurance company may not pursue it. At least, that's the way things work in this state. In this state, if there is a legal judgement against an uninsured motorist, their driver's license can be taken away until it is paid. In that case, some people pay the judgement, and some are so used to driving without a license that they don't seem to care. It all depends on a state's specific laws.

Judy, I am glad that neither of you were hurt. That no one was hurt. Whenever I have to stop in traffic I always find myself tensing up and looking in the rear view for that very reason. With so many distractions like cell phones and stressed out people, you just never know who is coming up behind and if they are paying attention. I am sorry about your accident. Make sure you get all checked out, pay close attention to your aches and pains. Something could show up months from now that is related to this accident. I will keep you in prayer. MJ

I am sorry to hear you have more bad news. Car accidents are never any fun. I dealt with a mess one time where I took my car to be repaired. It was involved with a hit and run. I had to prove I was at work and then they thought I was lying to hide a bf or something. They did go with me to the guy repairing my car. His story didn't add up and so they arrested him. I had to wait until he was sentenced until he was made to pay for my damages. It was quite an ordeal. I am most worry how you and dd feel right now. I am sure any extra stress isn't very good for you.

I'm so sorry to hear this! What about calling the Legal Aid Society in your area? Or one of those TV lawyers? I have worked with the Legal Aid Society in California and they were great. I have never worked with a TV lawyer but this sounds like a good case for a credible attorney. But then I'm just a cook Smiler Be well!

Well, the other shoe dropped. I talked to the adjuster of the "at fault" insurance company and he said the insurance policy of the "lady" who hit me was not effective until 5:25pm Saturday. The accident happened around 5pm. Apparently after the accident and while we were all sitting in our cars awaiting the arrival of the police she called Safe Auto on her cell phone and got an insurance policy and that is the policy # she gave me and the police.

The driver of the car you hit should be able to tell them if they were hit 1x or 2x....I got rear ended and was the front car and that's all they wanted to know from me. Who was ticketed? In my accident, only the last car that shoved the other car into me got ticketed. If I'd reported being hit 2x, both would've been ticketed.

Oh, and the rear of my car didn't look damaged but there was something like $1500 worth of damage underneath. Those bumpers are designed to do that.

Good luck and fight it if need be. Sorry to hear dd lost her reliable, paid-for transportation. Hope she comes across a good deal. I used a guy last time I bought a used car. He was a buyer's broker. It's very important though that you make sure he/she is working for you and not for a commission on the car sale. I paid a flat $300 fee and that was what he earned on the transaction regardless of how much I spent. Best money I've ever spent in a car deal.

I didn't mean another accident on another day. He was saying that the damage makes it look like I rear-ended the car in front of me and then was hit from behind by the other car.
I agree that that is what the damage makes it look like. After 20+ years of taking auto accident reports over the phone (my previous job) I know it is highly unusual to get hit from behind and sustain very little damage to the rear end of the car. I went and looked at it today and the rear bumper just has a few scratches on it. I don't understand how she could have hit us that hard (& it was hard) and not do any damage to the rear end of our car.

If your daughter had had a previous accident to that extent, there would be a record of it. Since there is no record of it, it seems it is pretty obvious she wasn't in a previous accident.

He also said I might have a problem if the other lady tries to say we had already had a wreck before she hit us because there is not as much damage to the rear as there is in the front.
If they only pay her book value for the car she will wind up having a car payment whereas she didn't before.

SmilerI thought about trying to make it sound more like that (especially since we had just been to the National Body Challenge Weigh-In) but I was blank.
I am a little stiff this morning especially my left side. Even my eye muscles. I guess they tried to come out of their sockets. You know, like in cartoons. Dd is still asleep so I don't know how she is feeling.

We made it thru Friday 13th with no problems but that Full Moon Saturday was a real doozie Wink
